1. Acceptance of Terms

By accessing or using VirtexPay, including Virtex Gateway, Virtex Payouts, Virtex Wallet, and Virtex Debit Cards, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Description of Services

VirtexPay provides a digital crypto payment ecosystem comprising:

• Virtex Gateway — A cryptocurrency payment gateway for businesses to accept crypto payments
• Virtex Payouts — A crypto-to-fiat off-ramp and payout service that withdraws gateway earnings to bank accounts and debit cards
• Virtex Wallet — A multi-chain crypto wallet (mobile app for Android and iOS) offering custodial and non-custodial modes and built-in token swaps
• Virtex Debit Cards — A crypto-backed debit card service (coming soon)

3. Eligibility

To open and own a VirtexPay account you must be at least 18 years old and legally capable of entering into a binding agreement. By using VirtexPay, you represent and warrant that you meet these requirements.

The Services, including Virtex Wallet, are not available to anyone under 18, and we do not knowingly allow minors to use them.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account at [email protected].

5. Prohibited Uses

You agree not to use VirtexPay for:

• Any illegal or unauthorized purpose
• Money laundering, terrorist financing, or sanctions evasion
• Fraudulent transactions or chargebacks
• Violating any applicable laws or regulations
• Attempting to gain unauthorized access to any part of the platform

6. Transaction Fees

Applicable fees for using VirtexPay services are displayed on the platform at the time of transaction. We reserve the right to modify our fee structure with reasonable notice to users.

7. Cryptocurrency Risks

Cryptocurrency transactions are irreversible. The value of cryptocurrencies is highly volatile. VirtexPay is not responsible for losses resulting from price fluctuations, network congestion, or blockchain errors. You acknowledge and accept these risks.

8. Intellectual Property

All content, logos, trademarks, and software on the VirtexPay platform are the intellectual property of VirtexPay or its licensors. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Limitation of Liability

To the maximum extent permitted by law, VirtexPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any services provided.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if we reasonably believe you have violated these terms, applicable law, or for any other legitimate reason. You may also close your account at any time by contacting us.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or the appropriate courts of jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. Continued use of VirtexPay after changes are posted constitutes your acceptance of the new Terms. We will provide notice of material changes via email or platform notification.
